  1. Acceptance 

This Privacy Policy (this “Policy”) concerns the information we collect when you use http://www.tintocoldbrew.com (our “Site”) to purchase our products or interact with any content on it (our “Services”).  

This Policy describes our privacy practices and how you can exercise your rights with respect to your information. You are required to review this Policy before using any of our Services. By accessing our Site and using our Services, you agree to this Policy. If you do not agree to this Policy, you may not use our Services. 

Your use of our Site and Services is also conditioned upon you agreeing to other applicable policies and agreements that apply to our Services – including our Terms and Conditions, Returns Policy, and Shipping Policy. 

All references to Tinto Cold Brew, we, us, and our refer to Tinto Cold Brew LLC, the entity providing the Site and Services. All references to customer, user, you, and your refers to anyone accessing our Site and/or using our Services. 

  1. The information we collect and why

Under this Policy, “personal information” refers to any information that can be used to identify a natural individual. When you use the Site and our Services, we collect the information you provide and those we collect automatically using various tracking technologies. 

  1. The information you provide

We collect the information you provide to us when you use certain areas of our Site. You are not obligated to provide us with this information, but our Service may not be possible if you do not provide such information. You may provide us with this information when you take the following actions: 

  • Registering and updating your profile: If you create an account on our Site, we will collect the information you input in the registration form. Likewise, we collect any additional information you provide to complete your profile. The information you may provide under this category may include your name, email address, username, password, picture, and similar details. We use this information to create a profile for you, host your content, send you administrative messages, and personalize your experience.
  • Uploading content: We will collect the information you share when you submit content, such as comments and reviews, on the Site. 
  • Making payments: Depending on the payment method you select; we will collect the payment method and billing information you provide when you purchase an item on the Site. Your payment method and billing information may include your address, name, and details on your credit card, email address, and phone number. This information is used by our third-party payment processor strictly to process your purchases of our coffee products. 
  • Contacting us: We will collect your name, email address, and pertinent information when you use our contact form or directly message us via our email address or phone number. We use this information to respond to your queries, inquiries, and questions, as well as 
  • Subscribing to our newsletters: We will collect the email address you provide when you subscribe to our newsletters. We use your email address to send you the news you subscribe to. 
  • Submitting orders: We will collect any information you submit in association with ordering our coffee products. The information may include your shipping address, location, payment, and order information. We will use this information to receive your order(s), communicate with you, deliver your orders, and receive your feedback or complaints. 
  1. The information we collect automatically

When you access the Site or interact with certain portions, we gather certain information automatically using cookies and similar tracking technologies, as well as third-party tools and APIs. The information may collect automatically may include:

  • Analytics and usage information: We collect analytics, such as the pages you access on our Site, your duration of use, your referring URL, search terms, and products you interact with. We use Google Analytics to gather analytics, and we do this to identify how users use our Site, what products are interacted with, and how we can improve our Services. 
  • Transaction information: We automatically collect the details of any purchase or transaction you make on the Site. This may include the items purchased, the amount, date and time, and the like. We collect this information to comply with our legal obligation of keeping records and for our protection in the event of disputes. 
  • Device information: We collect information about your device, including your device IP address, operating system, browser type, internet service provider, geolocation, and other identifiers. We collect this information to remember your device, save your inputs and login, detect spam, pinpoint your geographic location, and monitor violations of our Terms and Conditions and applicable laws.
  1. Cookies and similar technologies

We and third-party service providers use tracking tools, such as cookies, beacons, pixels, and tags on our Site and Services. These tools are tiny pieces of data and images attached to our Site and on some of our content to enable us to perform certain stuff, including gathering information, remembering user inputs, enabling certain functions, securing our Site, detecting violations, and identifying areas that need improvement. 

Cookies: The cookies we use on our Site may be either session cookies or persistent cookies. A session cookie is a cookie that expires when you leave our Site after a browsing session. A persistent cookie, on the other hand, does not expire when you leave our Site, it may exist between minutes to years depending on its set expiry date.  

As highlighted above, our third-party service providers – for example, our payment processor and analytics partners – may set their own cookies on our Site to provide their services. 

You can control the way cookies are used on your browser. The privacy settings function of most browsers has settings for accepting and rejecting cookies. Please, be informed that if you reject any cookie, it may disrupt the function the cookie performs. 

Other tracking technologies: Like cookies, similar tracking technologies, such as beacons, pixels, tags, and GIFs are tiny images embedded in content to anonymously track if a user has interacted with a content. 

  1. Analytics 

We gather analytics on our Site through Google Analytics. These analytics contain pieces of information described in section 2b above (the information we collect automatically). And they are used mainly for marketing purposes. However, you can download the Google Analytics Opt-out Add-on if you do not want us to gather analytics about you. 

  1. Woocommerce; Host

Our Site is built on Woocommerce, an e-commerce SDK built by Automatic, Inc., the provider of WordPress and other products. Automatic Inc. provides us with a number of services, and they may have access to your information. Please, review Automatic Inc.’s privacy policy to learn about how they may use your information. 

  1. Marketing emails and updates 

If you submit your email address in the newsletter subscription form or opt in to receive updates and marketing emails from us on the checkout page, we will occasionally send you marketing emails related to product offers, bonuses, discounts, and the like. You have the right to request that we stop sending you marketing emails by using the “unsubscribe” instructions at the bottom of any email we send to your email address. Please, be aware that unsubscribing from marketing emails will not prevent us from sending notices regarding orders and other administrative messages. 

  1. Information disclosures

We may disclose your information to third parties under the following circumstances:

  • When we hire service providers: We may disclose personal information with the third parties we hire to perform parts of our Services. We may share information about you to third parties that provide us with tasks such as payment processing, order fulfillment, website hosting, analytics gathering, website security, and fraud prevention. These third parties may be unable to perform these tasks without access to your information (for example, our third-party payment processors require your payment method information to deduct the applicable amount from your payment method). 
  • When you post content: If you submit any content, such as comments, reviews, and pictures on our Site, other users may have access to your content if they are posted on public parts of our Site (for example, users will be able to see your profile picture and comments made on our articles). 
  • When the law requires it: Applicable law enforcement may demand that we share personal information about you concerning any disputes, claims, or cases of national security. We may also disclose your personal information to public and private entities if it involves protecting our rights and properties or the rights and properties of other users or third parties. 
  • If we engage in a business transfer: A business transfer refers to any activity around selling our assets, merging with another entity, consolidating with other businesses, selling our company to another entity, or entering a state of bankruptcy. In any of these circumstances, the sharing of your information may be required to effect the transfer. 
  • When you request it: We will share personal information with a third party at your request (for example, where you request that we transfer your information to another service provider – as available under certain state laws).

We take your privacy very seriously and have implemented appropriate technical and organizational measures to protect it from unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to, using a reputable data storage provider, encrypting your information where necessary, using secure servers, and the like. 

Please be aware that no information transmission over the internet is ever completely secure or error-free. Therefore, we cannot guarantee that your information will totally be free from unauthorized access or use. 

We also ask that you take care when handling and disclosing your personal information and remind you that you are responsible for keeping your password and other account information confidential.

We will notify you and any applicable regulator of any unauthorized access, alteration, disclosure, or destruction of your personal information or unauthorized access to your account, where we are legally required to do so.

  1. How long we retain your information

We retain your information on our database for as long as the purposes for which we collect it are achieved. If you exercise your right to delete your information, we will delete it in accordance with applicable laws. If you leave a comment on our Site, we retain the comment and metadata indefinitely. This is so we can recognize and approve follow-up comments automatically instead of holding them in a moderation queue. We retain and use any information we collect automatically for shorter periods. 

  1. 10.Where we transfer your information

Our Site and Services and the processing of your information occur in the United States. However, we may transfer your information, and it may be processed in accordance with the privacy laws of any location a third-party service provider is. This means that your personal information may be processed and used in locations with privacy laws that are inadequate compared to this Policy. Nevertheless, we only work with third parties who practice adequate data protection as this Policy.

In accordance with the Children’s Online Privacy Protection Act (COPPA), we will not knowingly solicit, collect, use, or disclose personal information belonging to children (a minor) under 13 years of age without prior parental consent. If we discover that a child under 13 has provided personal information to us without parental consent, we will take immediate action to remove this information from our records.

  1. 12.Your privacy rights

You have the following rights with respect to the information we collect about you when you use our Services:

  • Editing and correcting your information: You may request that we correct any inaccurate information about you, including your billing information, payment method, and associated details. This right may be exercised from your account settings section (if you open an account) or by reaching out to us at melissa@tintocoldbrew.com
  • Erasing your information: You have the right to request that we delete your information from our database at any time. You can request to delete your account information, including payment and billing information by going through the settings function of your account. However, this does not apply to any information we are required to keep for administrative, legal, or security purposes (for example, your transaction details and comments). 
  • Requesting information transfer: You can request that we transfer your information from our Services to another service provider in a reasonable file format. You can get in touch with us at melissa@tintocoldbrew.com to make this request. 
  • Withdrawing your consent: If you have provided us with any information based on consent, you have the right to withdraw your consent at any time. 
  1. 13.Third-party links

Our Site may contain links to other websites and services operated by third parties. We have no control over the privacy practices of these third-party websites and services and encourage you to read their privacy policies before providing any personal information to them. We are not responsible for the content or privacy practices of third-party websites, and this Policy does not apply to any information you may provide while visiting such websites and services.

  1. 14.Do Not Track signal

A Do Not Track is a browser feature that, if activated, prevents website owners from tracking your online activities. At this moment, we do not respond to this signal even if you activate it. This feature is inconsistent among industry participants. 

  1. 15.California privacy rights

If you are using our Services from the state of California, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), you have the following rights:

  • The right to know the categories of personal information we have collected, used, and disclosed about you to third parties in the past 12 calendar months. 
  • The right to request to edit or delete your personal information from our database. 
  • The right to opt out of the sale of your personal information for direct marketing purposes. We are not in the practice of selling personal information to third parties for monetary consideration. 
  • The right to non-discrimination for exercising your rights under the CCPA and CPRA.

  1. 16.Nevada privacy rights

If you are a Nevada user, you have the right to opt out of the sale of your personal information to a third party for monetary consideration and for that third party to resell it to additional third parties. 

We do not engage in the sale of personal information; however, you may still reach out to us at melissa@tintocoldbrew.com to opt out of any future sale of your personal information.

We may review and change any portion of this Policy from time to time due to changes in our practices or any applicable law. If we make any changes to this Policy, we will post the changes to this page, and the changes made will immediately become effective. We advise that you frequently review this page to be up to date about our privacy practices.
